Article 1 — Parties
This agreement is concluded between the BUYER placing an order through the website shop.ferarts.com, and the SELLER Henks Ticaret ve Bilişim Hizmetleri A.Ş. (MERSİS: 0461039910500019, Tax Office: Urla, VKN: 4610399105, Address: M. Fevzi Çakmak Mah. Mustafa Kemal Bulvarı No:40A, 35445 Urla/İzmir, Turkey, Tel: +90 232 332 2432; contact: via the contact form on the site), pursuant to the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
Article 2 — Subject Matter
The subject of this agreement is the rights and obligations of the parties regarding the sale and delivery of the handmade ceramic product(s) ordered by the BUYER electronically through shop.ferarts.com, the specifications and sale price of which are stated on the order page.
Article 3 — Product and Price
The type, quantity, specifications, and the sale price inclusive of all taxes are set out in the order summary at the time of ordering and in the order confirmation sent to the BUYER. The products are handmade; the glaze and texture take on unique tones in each piece — such variations are not defects but the nature of handcrafted production.
Article 4 — Delivery
Collection products shipped from stock are dispatched within 2 business days following payment confirmation. For custom/personalised chef productions, the production time is 2 to 8 weeks depending on order quantity; the estimated time is communicated in the order confirmation. Delivery is made by courier to the address provided by the BUYER. The statutory maximum delivery period is 30 days; for custom productions, the period agreed by the parties applies.
Article 5 — Payment
Payment is made by credit/debit card via the secure payment infrastructure provided on the site. Card details are neither seen nor stored by the SELLER; payment is processed through a licensed payment institution.
Article 6 — Right of Withdrawal
The BUYER has the right to withdraw from the contract without stating any reason within 14 (fourteen) days of receiving the product, for collection products shipped from stock. The withdrawal notice must be made in writing via the contact form on the site. In the event of withdrawal, the product must be returned unused, undamaged, and in resalable condition, packaged with protective wrapping against breakage; the BUYER bears full responsibility for any damage occurring during return shipping. The return shipping cost is borne by the BUYER. The refund is made to the payment method used, within 14 days of the product reaching the SELLER, provided the SELLER confirms receipt of the product undamaged and unused.
Article 7 — Exceptions to the Right of Withdrawal
Pursuant to Article 15/1-c of the Distance Contracts Regulation, the right of withdrawal does not apply to goods prepared in line with the BUYER's requests or personal needs. Accordingly, products custom-made for the individual/chef (custom form, size, colour, or texture work) are excluded from the right of withdrawal; this is expressly communicated to the BUYER before the order is placed.
Article 8 — Damaged Delivery
The products are fragile and are shipped with special protective packaging. The BUYER should inspect the packaging upon delivery; if damage is suspected, a report should be filed with the courier. Damage discovered after delivery must be reported with photographs within 48 hours of delivery via the contact form on the site. In the event of delivery of a damaged or incorrect product, following the SELLER's approval of the return, the return is carried out using shipping arranged by the SELLER at the SELLER's expense; the product is replaced or the price refunded, at the BUYER's choice.
Article 9 — Disputes
Disputes arising from this agreement shall be subject to the jurisdiction of the İzmir Courts and Enforcement Offices. For international deliveries, import duties and customs charges are borne by the BUYER.
Article 10 — Entry into Force
By confirming the order, the BUYER is deemed to have accepted all terms of this agreement. The agreement enters into force upon order confirmation.
